Longboat Key Zoning Code Analysis

  1. WHAT IS INCLUDED IN THE LONGBOAT KEY ZONING CODE?
    The Zoning Code is contained in Chapter 158 of the Town of Longboat Key Code of Ordinances. The Zoning Code specifies how land may and may not be used throughout the Town (zoning). It also details measurable numerical requirements (development standards) such as how many housing units can be built on an acre of land, how much of the lot a structure can cover, or how much parking and landscaping is required. The Zoning Code also specifies the process of approval for new development, redevelopment, or rehabilitation and expansion of existing structures. It is important that the Zoning Code remain relevant so as to reflect the current vision of the Town, and in order to ensure the standards contained therein produce the desired character within the built environment.
  2. WHERE ARE WE CURRENTLY IN THE ZONING CODE REWRITING PROCESS?
    The Code rewrite process is in its very initial phases. One of the Town’s first priorities in rewriting the Zoning Code is to create a Planned Unit Development (PUD) zoning process. This process is being established in order to address existing impediments to redevelopment of properties that do not conform to the current Zoning Code and Comprehensive Plan while requiring that any new development preserve the existing character and natural beauty of the Town. The Town is currently in the process of drafting these PUD regulations.The draft PUD regulations will be vetted through a series of public workshops and hearings. In the meantime, a preliminary outline which sets the framework for the remainder of the Zoning Code will be developed. Input from a series of workshops will be used to identify what is working, what is not working, and what components need to be updated or changed within the code. Information and feedback garnered from these workshops will be used to form the content of the new code. A draft of the new code will eventually be created and will also be fully vetted through a series of public workshops and hearings.
  3. WHAT IS PLANNED UNIT DEVELOPMENT (PUD) ZONING?
    Planned Unit Development (PUD) zoning is a method of development that allows development standards to be created and approved based on the uniqueness of a site and/or the uniqueness of a particular project. In Longboat Key, the PUD zoning process is being proposed as a way to addressed needed redevelopment of the many sites that do not conform to the development limits of the Town’s current regulations. Because PUDs are established as zoning districts, the process requires rezoning the site to PUD with a custom set of development standards that are proposed by an applicant, reviewed by the Town staff, and ultimately approved, denied, or modified by the Town Commission. A set of minimum standards applicable to all PUDs will be developed as a part of the creation of the PUD zoning process. Modification to PUD standards within the bounds of the minimum PUD standards are often made during the review process based on input from Town staff, the Planning and Zoning Board, the Town Commission, and the public. Other important features associated with PUD zoning include the following:

    • They require the submittal and approval of a concept drawing and written development standards that will govern the future development of the site.
    • They typically allow mixed uses including mixed uses within the same building which cannot be accommodated by standard zoning districts.
    • They should encourage innovative and higher quality developments in exchange for flexibility in the application of development standards. Such innovations can include greater open space requirements, greater buffers, architectural standards, and enhanced amenities.
  4. HOW DOES THE PROPOSED PUD ZONING DIFFER FROM THE CURRENT PUD SITE PLAN REGULATIONS?
    Longboat Key currently has a PUD site plan process contained in Sections 158.065 through 158.071 of the Code of Ordinances. These existing regulations, however, are not a true PUD zoning process that would encourage the types of innovative and high quality developments as is being proposed. Under the existing PUD site plan regulations, the zoning designation and the associated development standards under the zoning designation of the site do not change, although the process allows the applicant to request Departures, Waivers, and Variances from these regulations. Existing developments that were approved under the current PUD site plan process will not be affected by the proposed PUD zoning regulations and will remain conforming.
